Selecting upgrade offers all plans

We have free, premium, premium upgrade and premium subscription plan options for users.  The free and premium are base plans.  If they select a free plan and then decide to upgrade they are presented with the standard premium plan in addition to upgrade options?  Is this right, I thought you would only get the upgrade options?
